It's not a crime because it literally was investigated and determined to not be a crime by the FBI. I don't actually think she was careless, I think she probably got bad advice from people who she was relying on to be subject matter experts.

I really don't. In the OJ case, the police determined that a crime had been committed and used evidence to charge him with it. In Hillary's case, the FBI determined there was no crime. Pretty different scenario.
