Well you implied differently with your use of "changes a little". Implying that there's still an argument for rape to have occured.

Potentially, yes. But not when both parties have agreed because that's stupid. Read my post.

If I am being black and white, it's not purposefully. I'm basing the accusations of rape on those grey areas as was displayed with DWV's post. Obviously it's all based on situation. But I've also said that I agree with your statements just not entirely.

Let me throw out a situation then and we can discuss it further:

My ex and I were drinking, one obviously more drunk, and we had sex that night. Neither said whether they wanted it or not, it just happened. However I know that drinking can be a factor, is that rape? Drinking can alter your judgement therefore having an effect on whether you can say no or yes.
