The law doesn't care how you "feel." You actually have to be in immediate danger to use deadly weapon. What you are not allowed to do is use a deadly weapon against someone who has not used one on you & more importantly use such actions simply based on "feelings."

He is not being held as of now, but the case according to the commissioner is under review. If not criminally, that man deserves to be financially raped by those bikers he ran over.
