The option should still be available whether you personally use it or not. That is the restriction. I'd liken that attitude towards people thinking that gay marriage restrictions aren't oppressive because they don't think marriage is a big deal. Being oppressed entails being stripped of your rights because of someone else's moral standing.
Also to answer your earlier question, it's called micro aggressions. Some of the popular examples are a bit of a reach, but if you look at the implicit attitudes with things such as rape victim blaming and slut shaming.
