If you have a white person and a black person applying for the same job and they are both qualified for it. Employers are more likely to hire John than they are to hire Jamal.
It's based off of underlying prejudices that people aren't even aware of subconsciously. Yes it is illegal to do that but there is also no way to prove that it was that reason alone that determine them to hire John over Jamal. If there was evidence then the ACLU could get involved.
