Bassam Al-Rawi, Halifax Cabbie Acquitted In Sex Assault, Is Victim Of Racism: Lawyer
ok so like this has been a pretty hot topic of conversation in canada recently and there was a huge protest in my city today. the tl;dr version of the story is that a cop found a cab driver with his pants down in his cab with an intoxicated unconscious woman who was also half-dressed. there was no evidence that sexual intercourse had taken place, but obviously it looks quite bad to be caught in this situation.
the big controversy has less do to with this, and more with the judge who made the statement:

Lenehan said a person is incapable of consent if they are unconscious or are so intoxicated that they are unable to understand or perceive their situation.
"This does not mean, however, that an intoxicated person cannot give consent to sexual activity,'' he said. "Clearly, a drunk can consent.''

now maybe i'm a ****ed up individual, but i think the outrage over his comment is ludicrous. there is obviously a line of being drunk and able to give consent, and a line where you are unable (considering she was unconcious, i have to believe she was probably unable but that's kinda neither here nor there.)
anyway interested in hearing thoughts on this issue
