The guy who died is responsible, nobody else. If he had just handed it over and said yeah, you got me officer, he might have got away with it for all we know. I've seen police do that before if it's a small amount for personal use (not me but people I was with). But this guy walked off and it appears he tried to hide the evidence.

He most likely had more than what is considered a personal use amount which to be fair, is typically very small for schedule I drugs.

nice strawman. The officer is not directly responsible, it's indicative of a wider use of archaic laws. Not to mention that there are loads of drug users who turn to heroin and other street opiates to manage their pain, which adds a lot of grey area to the idea that having drugs means that you're choosing to break the law.
