First off - the first half of what you said is spot on, and I don't disagree with you. He isn't above the law, and that's why him and all of his administration and ties to Russia are being investigated. While what you say about there needing to be good faith/common sense measures is true, that also includes due dilligence and getting the charges right. Like I said, I think there's some deniability that Trump has in facing criminal charges for firing Comey, and Mueller is aware of that.
