My first instinct was to just tell him no I won't take out my earbud, but that turns it into confrontation I'll definitely lose if it goes up the chain but now I'm thinking if he wants to exert his "power" I'll just make him exert it constantly until he just gets sick of it. Keep my earbud in every day and make him tell me to take it out. Then when he gets used to telling me to take it out at the beginning of the day I start putting it in later in the day so he has to keep a constant eye on my ear all day. Just make it so annoying that he gives up. I mean if he were really such an energetic and competent authoritarian he wouldn't be working at Burger King and only becoming a manager at the age of 30.
