Yes, but it's also his job to sell cars that actually work. He knew what was wrong with it when he sold it. And are you actually defending a used car salesman???

There is a such thing as a lemon law..and it protects both the consumer and the producer...and I maybe defending him..and he is only responsible for making sure she/he can drive it off the lot..anything after that isnt his responsibility..

But if he witheld prior knowldege of problems with the vehicle then he does have fault in the issue.

He is protected under certain laws...and unless asked prior to it being paid and driven off..he doesnt have to let her know anything...its the consumer's responsibility to ensure the quality of a product....especially if it doesnt come with a guarantee.

"Sir do you have a carfax on this vehicle"

If he denies..he has lied and can be held accountable..if he is never asked..well..then no.

She did ask if there was anything wrong with it and he said that these wasn't. Not telling the truth constitutes a lie. Lying by omission also constitutes a lie.
