Because they're bound to uphold the law as it's written in English Law, not what they want to do. How is that hard to understand? They're not free agents: they work for the government/monarch. They are as bound by the Law as anyone else is.

Judges also have law degrees. Surely the judge knows what the maximum sentence is. Fancy yackityyack shouldn’t matter.
