The premise that the death penalty for murderers is a cherrypicked scenario that holds very little merit within the discussion we're having. Like I said previously, having a no-tolerance policy on sexual harrassment is more akin to having laws against murder.

Okay. I'm gonna try this one more time, and I'm gonna break it down in the simplest terms I can find:
Rules are not discriminatory unless they're certifiably unfair.
Also, is this about the hypocrisy of killing someone who killed someone or discrimination? Figure it out first.

No they don't, if they own a legit business with a license sanctioned by the government that represents everyone, they don't get to choose without having a valid reason, which being black, gay, short, ugly or homeless is not.
