Regardless, to get there, there would need to be serious evidence and I think the issue would have to be outside the jurisdiction of lower courts.

Yep, I've heard this too. Also there have been a few slap-downs of Trump inspired cases in the supreme court, haven't there? If you're a judge, this might be your thinking: " OK, the GOP got me here, but now I'm here for life. I can please myself, and I'd like my judgements to look good in the history books."
