Intellectual copyright laws

I have a question that may be hard to answer for those not schooled in North American corporate law. I imagine Canada and the US are very similar.

My question is this. If a major record company like EMI buys up a smaller company (for examples sake lets use Jello Biafra's Alternative Tentacles.) can they now legally block your Dead Kennedy songs you put up on youtube, even if you owned the record years before the take over?

Just curious if anyone would know?

I don't know, but I would assume all rights to the music passes to them, and they can act on that retroactively. Just as Jackson could have, technically, sued people for using Beatles music, even if they bought it when the Beatles were going? I would expect that they basically get the right to do whatever they damn well like with their new power.

I could be wrong of course, but it sort of doesn't make sense any other way. The same way Viacom could go after copyright on Star Trek after they bought Paramount. And so on.

I suspect your probably right. That irke's me though. A personal favourite band of mine from the 90's has had their indie label rights bought up by EMI.

Now EMI goes around blocking the video I put up on you tube under copyright infringement, but I don't have any EMI logo or affiliate on my copy of the CD!

The majors now hold the distribution rights to a lot of old punk bands as well, Minor Threat, the Misfits ect, so I imagine they will start getting blocked on youtube at some point.

Sorry for the necromancy here but I'm looking for information/hoping to start a discussion about the situation with Youtube and Facebook now. This isn't news or anything but basically any video uploaded with music on it is blocked or removed. I understand people are able to alter the pitch or change the music tracks somehow so that they can be uploaded but why does it seem like the vast majority of music has been uploaded illegally and why isn't it taken down?

I'm annoyed because I make short videos documenting daily life/traveling and I always add music, I'd like to be able to share them somehow on Facebook and/or youtube but nothing works. Is there a way to legally do it or should I just not bother? And are there specific rules about using music listed somewhere? If so, are those rules possible to work with?

I thought it was okay to use like 30-second clips but it seems like that will get you in trouble, too. And then there was the guy who's account was blocked for using just one word or lines from songs. Ugh. Will it ever end?

I've had some videos that used copyrighted music as a background to say a slide show. YouTube have tagged them with something like "Detected third party content", but they don't delete or remove them. I think they claim it gives them the right to put an ad on your video or bombard you with ads when you log in, though that happens anyway. I think unless you're emailed to say you have to delete the file or it's been deleted, there's a certain amount of leeway allowed. I think it also depends how much of a song you use. After all, just about everything is somebody's copyright now, other than maybe classical music. We can't all write music ourselves to accompany our videos.

See that's the thing. I'm definitely using "third party content" but it never gives me a warning, it just removes the content. I wonder what I'm doing wrong. Or if the laws change from country to country.
