Yes but the expression is Flogging a dead horse.

It doesn't mean it was flogged to death it means it's flogged after it's dead

Ahh, but I didn't disagree that it wasn't about to be flogged, only that it appears not to have been.

Not at all, my theory is that the transgressors, ie the floggers, snuck up to the horse in its sleep and began to flog it. The horse then woke up and retaliated against its attackers, but not before sustaining serious damage to the ribs and lungs. After kicking its attackers to death, it doubtlessly began to wander in search of an animal clinic, but found that its strength was quickly waning. Thus, it lay down on its broken side (doubtlessly very painful) out of pride, to hide the fact that humans were able to best it. What a noble creature... and what scum to flog it!
