I don't think that, using the example of the "Sweet Dreams" sound, anyone is really gonna' recognize something like that outside of the context of the song its taken from.
I mean it's not like a sample where its the same key and tempo and ultimately the same piece of music. In that situation, yeah, you're like "they totally bit that off someone else".
How many times have you listened to a moog synth and said "oh, they totally stole that from Rick Wakeman"?
The only real difference between a soft synth and a hardware synth is that w/ a hard synth the patches are in the keyboard itself and a soft synth usually offers more flexibility and a better interface. Other than that they're the same
I do agree that a preset patch can be a good jumping off point for tailoring your own sound. There's no point in starting from zero when a patch can get you in the neighborhood you wanna' be in.
As far as performance is concerned a good performer will tweak in real time and make it a part of the performance.
