Look at marriage for example. If you go in without a prenupt the less wealthy party has way more economic leverage in terms of threatening divorce. If you go in with a prenupt the scenario is reversed.

Or even in a relatively l relationship.. one party is often more invested it than the other. They are the one with less leverage in that relationship. I'm sure you can relate.
