My super fun awesome final weekend before school starts is turning into a real shitter. I was suppose to go out to the bar with a friend from way back last night but he canceled because his parents already arranged an evening for him, much to his chagrin. My gaming night tonight seems to be off due to unknown reasons, I just got a voice message from one of my gamers that said bad news regarding tonight's gaming session. He also hinted that future gaming dates may have to be rethought. So instead of spending my last weekend of the summer in the presence of friends, I get to spend them by myself with weed and video games. Not as bad as it could be, but I'd take friends over a night of smoking pot alone and playing video games.

I'm absolutely fuming tonight at the news that my 15 year old niece was stopped and searched by police this evening. Apparantly the owners of a local chinese take-away had called the police to report that there were some kids there or outside there causing bother and so they sent a couple of officers around.

In the meantime my niece and a couple of her mates happened to pass the place as the police pulled up. They then stopped them and despite my niece explaining to them that they had just got there took their names, asked them if they "had anything they shouldn't", whatever that means and then proceded to search them. They did not give a reason, a copy of the report or as far as i'm aware any of their information such as names of numbers.

I may be no expert when it comes to the rules for stopping and searching people but if you can do it without valid reason to suspect they will find something as a result, without giving them any information about themselves and without providing them with a copy of the report that also includes the reason given for performing the search then i will eat my hat. Of course they didn't give them a copy of the report, becasuse they don't have a valid reason to state on the paperwork!

Legally I think you have grounds for complaint.

Avon and Somerset Constabulary - Stop and stop search

Look at the section written record. They should've provided your niece with some form of receipt in the very least. The fact they didn't, especially in the case of minors unaccompanied by adults, is rather serious.

Oh i have already told my sister that she should file a complaint and she didn't need much convincing to do so. She has looked a little online, as have i, just to make sure of the rules.

They have only stopped and searched them because the owners of the restaurant have informed them that there was kids creating trouble, and my niece and her friends are kids who happen to have been in the nearby area when they got there and i really don't think that's good enough grounds.

Had they been asking them questions, maybe about if they had seen anything etc then thats fine but you can't take details and physically search someone just for being in the area a short while after something happened when you have no grounds to suspect they did anything.

Some coppers seem to think they can do this though, it seems. I have been stopped on more than one occasion to be asked what i was doing while simply walking back from the pub.

Ugh I hate hearing about cops who can't do search and seizures properly. Even if they did find something like an illegal knife or drugs it's not dismissible in court because there's no probably cause for the search. The reason they didn't issue your niece a report or receipt or anything was because they didn't want to do the paperwork and assumed the victim would just grumble about it to themselves and maybe a few friends. I don't want to say don't file a report against the officer, but don't hold out hope that it will amount to jack. He'll most likely get a lecture from his commanding officer and if you raise enough stink maybe the commanding officer's commanding officer will have a chat, but even then. It's a ****ty world out there and there are some shortcut techniques that have just become too common.

Junior year classes are dominating my life. Pre Cal/Trig, Spanish III, and AP US History are killing me. Adv. Piano II will most likely have the same affect once the studio is done installing the new lab and I get assigned my pieces.

Oh and my neighbors are a bunch of rednecks. Yes sir, I realize you have a large subwoofer in your car, but you don't need to make me feel like I'm in your '71 Chevy listening to Aphex Twin when I'm way up in my room. I have a theory that he can't hear anymore, so he needs to turn his music up to ungodly levels so he can feel it throughout every fiber of his being. It's the second best thing to him.

Oh I wouldn't expect it to come to anything really. But i do think it warrants a complaint. To be honest, personally i would settle for a reason. I am quite interested in being offered a reason why they were searched.

I did all my algebra homework pages, feeling so proud of myself, I turned my 3 page paper in to find out that we just needed to read the chapter, not do the problems... seriously! Who does that and does not specify what to do with the pages assigned?
