If I record someone else's music being played can I call it my own, since I recorded it?

No it's my music. If Cage can take credit for the sound that other people make than so can I. I'm gonna record hot 97 while I'm driving and sell it as Dwn's 4'20" Composition. The driving sounds add ambient sounds which separate it from normal radio tunes.

Why not go for it all you want. Just don't be mad when you get charged for copyright infringement.

Go for it. I'd recommend not doing it in rush hour though, I'm more a fan of low traffic sounds.

I'm not infringing it's mobile field recording. Are you saying that if someone in Cage's incredibly bored audience decided to listen to their own real music that Cage would get charged with copywrite infringement?
